Harvey Weinstein defense urges acquittal as rape retrial nears a close

NEW YORK – The trial of Harvey Weinstein, a significant figure in Hollywood, is back in the spotlight as his defense team argues for his acquittal in a case involving allegations of rape. This trial marks the third time these accusations have been brought to court, highlighting the complexities and ongoing discussions surrounding the #MeToo movement.

During the closing arguments, Weinstein’s lawyer, Marc Agnifilo, presented a strong case for his client, asserting, “It’s just not true.” He urged jurors to consider that the accuser, hairstylist and actor Jessica Mann, had crafted a “false narrative” about her experience with Weinstein.

Mann and Weinstein first met in early 2013 when she was trying to launch her acting career. Although she was initially surprised by his sexual advances, she chose to pursue a relationship with him, despite his status as a married man and a powerful producer.

Mann testified that their relationship turned dark when Weinstein invited her to a hotel room. She claims that when she entered the room to express her disinterest in a sexual encounter, he allegedly trapped her, forcibly undressed her, and raped her. “He just treated me like he owned me,” Mann recalled during her testimony last month.

Weinstein chose not to testify in his own defense. However, his legal team maintained that the encounter was consensual, arguing that Mann had fostered a caring relationship with Weinstein that lasted until the #MeToo movement gained momentum in 2017. Weinstein has acknowledged behaving “wrongly” in some instances, but he denies any allegations of assault.

This latest trial follows a convoluted legal history. Weinstein was previously convicted in 2020 of raping Mann, but that conviction was overturned. A subsequent retrial last year resulted in a hung jury, leaving the fate of the case uncertain.

In his closing statements, Agnifilo pointed to inconsistencies in Mann’s testimony and emphasized the friendly communications they shared before and after the alleged incident. He stated, “Throughout the four years, she is going to Harvey Weinstein for things that she needs, and Harvey Weinstein is doing the best that he can,” suggesting a supportive relationship rather than one marked by assault.

Regardless of the outcome of this trial, it is essential to note that Weinstein is already serving time for other sex crimes in New York and California, although he is appealing those convictions.

In cases of sexual assault, the Associated Press typically does not identify victims unless they choose to share their names. Jessica Mann has opted to go public with her story, contributing to the ongoing conversation about accountability and justice in the entertainment industry.
