Supreme Court ruling gives a reprieve to states with grace periods for receiving mail ballots

Recently, a significant decision by the U.S. Supreme Court brought relief to many states that allow mail ballots to be counted after Election Day. This ruling came in response to a challenge from the Republican National Committee (RNC) against a Mississippi law that permits counting mail ballots postmarked by Election Day and arriving within five days afterward.

The Supreme Court’s decision not only protects this law but also reassures voters in the 14 states that have similar grace periods for counting mail ballots. This ruling was particularly crucial with midterm elections approaching, as it prevents last-minute changes that could confuse voters.

For instance, Ohio had already altered its mail ballot laws in anticipation of a different ruling from the court. Additionally, 15 other states maintain grace periods for military and overseas voters, ensuring their ballots are also counted.

Washington Secretary of State Steve Hobbs expressed that this ruling means “the thousands of voters whose ballots are postmarked on time but received after Election Day still have their voices heard.” This underscores the importance of mail-in voting, especially as many Americans opt for this method to cast their votes.

Mail-in ballots, also known as absentee ballots, have faced scrutiny in recent years, particularly from former President Donald Trump, who has made unfounded claims about their role in his election loss in 2020. The RNC’s lawsuit aimed to challenge Mississippi’s law, claiming it conflicted with federal law. However, Justice Amy Coney Barrett, appointed by Trump, clarified that federal election laws do not require ballots to be received by Election Day.

In states like Illinois, where mail-in voting has become increasingly popular, officials had prepared to educate voters about potential changes to mail ballot deadlines. After the court’s ruling, those plans were scrapped, as mail ballots can still be counted if they are postmarked by Election Day and received within 14 days.

California, which has a seven-day grace period for counting mail ballots, has often been criticized for its handling of late-arriving ballots. Secretary of State Shirley Weber remarked that the ruling is a win for voters and democracy.

The decision also resonates deeply in Alaska, where many communities rely on mail-in voting due to their remote locations. Jacqueline De León, an attorney for the Native American Rights Fund, highlighted the challenges faced by Native communities, stating that ballots should not be discarded due to delivery issues caused by weather or inadequate postal services.

The ruling, however, does not come without controversy. Trump referred to it as a “tremendous loss” and used it to advocate for his election law proposals, which would impose stricter regulations on mail ballots. Meanwhile, Democratic leaders view the ruling as a hopeful sign for future cases regarding voting rights.

Overall, this Supreme Court decision reinforces the importance of mail-in voting and the need for states to ensure that every vote counts, particularly in a diverse nation where access to polling places can vary significantly.
