The U.S. Attorney for the Western District of Texas, Jaime Esparza, has announced an investigation into potential illegal voting activities linked to past elections. This underscores ongoing concerns regarding election integrity and the enforcement of voting laws across the state.

Esparza clarified that the cases currently under prosecution do not pertain to the upcoming 2024 election cycle. Instead, they focus on alleged violations from elections held in 2022 and earlier. “Most of these that we’re prosecuting right now are linked to 2024, 2022, and even further back,” he noted, indicating a thorough review of historical voting records.

Recently, Esparza announced charges against two individuals for allegedly voting illegally in federal elections connected to the November 2024 ballot. One of the individuals, Monica Ivette Carzoli Carillo, 46, from Del Rio, faces accusations of voting as a noncitizen. She had been a lawful permanent resident since December 2023 and reportedly cast an early-voting ballot on October 26, 2024.

Another case involves Imelda Magallanes, 51, of Midland, who is also charged with illegal voting as a noncitizen. Magallanes had lawful permanent resident status since December 2010, renewing it in 2023. Prosecutors allege that she registered to vote in October 2020 and subsequently voted in November 2024.

The investigative process typically involves a comparison of immigration records with voter registration data, as well as interviews to determine the validity of claims before moving forward with charges. Esparza explained, “The voter fraud really comes into play when someone registers to vote and falsely represents themselves as a U.S. citizen, subsequently casting a vote.”

The U.S. Attorney’s office collaborates with various agencies, including Homeland Security Investigations, to effectively pursue these cases. This effort aligns with a broader initiative in Texas, where the Secretary of State has been reviewing voter registration records, identifying 2,724 potential noncitizen registrations. As a result, 117 cases have been referred to the Texas Attorney General for further investigation into possible noncitizen voting.

While the investigation seeks to uphold the integrity of the electoral process, Esparza emphasized that enforcement actions should not discourage eligible voters from participating in future elections. “We want to ensure that the process remains open and accessible to all legitimate voters,” he stated, reinforcing the importance of civic engagement.
