A 25-year-old man from Central Texas, Brian José Morales García, has returned to the United States after being deported to Mexico despite his assertions of being an American citizen. His return followed a federal agreement reached with his legal team, prompted by new evidence supporting his citizenship claim.

Morales was deported in April 2023 after a police stop near Fredericksburg, Texas. During this encounter, he insisted that he was born in Denver, Colorado, and had lived and worked in Texas. However, law enforcement officials did not accept his claims and subsequently contacted the U.S. Immigration and Customs Enforcement (ICE).

Despite having documentation, including a birth certificate and social security number, Morales was deported. The U.S. Department of Homeland Security (DHS) contended that he had entered the country illegally, a claim his legal team vehemently disputed.

As Morales’s legal team prepared to challenge his deportation in court, they presented additional evidence, including hospital records, witness affidavits, and his certified birth record from Colorado. This new information led to the U.S. Department of Justice allowing his re-entry into the United States while litigation regarding his detention and deportation continues.

Kate Lincoln-Goldfinch, Morales’s attorney, expressed concerns about the implications of his case, stating, “Brian’s case raises an alarming pattern of behavior on the part of the federal government, demonstrating that they’re willing to racially profile, detain, and deport U.S. citizens.” Lincoln-Goldfinch emphasized the troubling precedent set by requiring extensive proof of citizenship from individuals born in the U.S.

Morales’s case is not isolated; it reflects a broader issue within the immigration system where American citizens can mistakenly face deportation. A congressional government report indicated that between 2015 and 2020, immigration agents arrested 674 individuals, detained 121, and removed 70 potential U.S. citizens.

While it is uncommon for U.S. citizens to be wrongly deported, investigations have shown that such incidents occur. For instance, a ProPublica investigation noted that more than 170 U.S. citizens were detained by immigration agents during the first nine months of President Trump’s second administration, though none were reported as deported.

Morales’s civil rights lawsuit against the federal government remains ongoing, highlighting the complexities and challenges faced by individuals in similar situations. His story serves as a stark reminder of the importance of safeguarding civil rights and ensuring due process for all citizens.
