ALBUQUERQUE, N.M. – A New Mexico judge has recently dismissed the serious charges against actor Timothy Busfield, known for his roles in “West Wing” and “Field of Dreams.” The allegations claimed he was involved in criminal sexual contact with a child. This decision came after the judge found that there were significant issues with how the prosecution handled the grand jury process.
State District Judge Joseph Montano agreed with Busfield’s defense team, stating that prosecutorial misconduct and errors in the case were damaging. Following the judge’s ruling, Busfield expressed his relief and gratitude, maintaining his innocence throughout the ordeal.
The legal troubles for Busfield began while he was directing the TV series “The Cleaning Lady” between 2022 and 2024. The parents of two boys, who were let go from the show, claimed that Busfield had inappropriately touched their children. According to a January criminal complaint, one of the boys alleged that Busfield touched him inappropriately on two occasions when he was 7 and 8 years old. His twin brother also stated he had been touched but did not provide specific details.
Busfield voluntarily turned himself in to authorities and was released from jail after the judge found no previous incidents involving children in his past. Shortly after, a grand jury indicted him on the charges, which allowed the prosecution to move forward without a preliminary hearing.
However, the defense argued that the initial statements from the children indicated that nothing inappropriate had occurred and claimed that the parents had influenced their children’s testimonies after the boys lost their roles in the show. In June, Busfield’s lawyers filed a formal request to dismiss the indictment, stating that prosecutors were ignoring the lack of evidence and had created obstacles that prevented the grand jury from hearing critical witness testimonies.
During a September hearing, Busfield’s attorney played recordings showing that grand jurors wanted to hear from more witnesses but were misinformed about the process. Fayerberg accused the state of engaging in severe prosecutorial misconduct. However, the Bernalillo County District Attorney countered that Busfield’s defense did not follow proper procedures for submitting evidence.
Busfield, during his testimony, described how the allegations had negatively impacted his life and career, stating he felt “canceled.” He firmly denied the accusations, declaring them “absolutely one gazillion percent untrue.”
With the charges dismissed, Busfield’s future remains uncertain, as prosecutors have not yet decided whether to pursue new charges. “We know this may not be the end,” Fayerberg noted, assuring that Busfield is prepared to defend himself if necessary.
