BEXAR COUNTY, Texas – Erik Cantu, a young man with a complicated legal history, is back in the news as he faces more court hearings. Since surviving a shooting by a police officer in 2022, Cantu has been arrested six times. He was supposed to appear in court recently for a motion to revoke his probation but will now return to the 187th Criminal District Court on Wednesday at 9:30 a.m.
His court appearance was postponed because his attorney, Charles Bunk, requested more time. He explained that an important witness for Cantu’s defense was not present, and Judge Stephanie Boyd agreed to the delay.
The court hearing was originally set to continue on Tuesday morning after starting on Monday. However, during the initial hearing, Judge Boyd did not make a decision regarding whether to revoke Cantu’s probation. Prosecutors presented many hours of evidence, including testimony from Cantu’s ex-girlfriend, Emily Proulx.
Cantu, who is now 21 years old, is accused of breaking into Proulx’s home in December and stealing her tablet. Interestingly, Proulx has asked the Bexar County District Attorney’s Office to drop the burglary charge against him.
During the hearing, officials presented GPS evidence showing that Cantu was at Proulx’s apartment while he was supposed to be on house arrest. This arrest triggered the upcoming court hearing since he was already on probation and monitored by GPS due to previous evading arrest cases.
This incident is just the latest in a series of legal troubles for Cantu, who was shot multiple times in 2022 by former San Antonio police officer James Brennand in a McDonald’s parking lot. The burglary charge came less than a month after Cantu was sentenced to eight years of probation for violating earlier probation terms.
Following Cantu’s most recent arrest, prosecutors moved to revoke his probation, which could lead to severe consequences. If his probation is revoked, Cantu could face up to six years in prison.
Meanwhile, Brennand, the officer involved in Cantu’s shooting, is facing charges of aggravated assault by a public servant and is scheduled for his own court appearance in mid-April.
