WASHINGTON – In a significant legal move, the Arlington County Board in Virginia has filed a lawsuit opposing the construction of the Triumphal Arch, marking the first time a governmental body has taken legal action against President Donald Trump’s proposed monument. The lawsuit was filed on Thursday in the Eastern District of Virginia, raising concerns about the expedited process that the project has undergone, particularly its failure to adhere to the full review process mandated by law.

According to the lawsuit, “The National Park Service, the agency responsible for projects on national park land such as Memorial Circle, is proceeding full-speed toward ground-disturbing construction.” The document argues that despite claims of an ongoing decision-making process, the pace of the project appears to be a pretext designed to fulfill the President’s directives.

The Arlington County Board is requesting that the court halt the “feverish pace toward construction of the arch” to ensure compliance with the National Environmental Policy Act (NEPA). This request underscores the need for a thorough analysis and testing to assess the environmental impact of the project.

Chair Matt de Ferranti, representing the Arlington County Board, remarked, “Our community has the most to lose from this egregious and unlawful proposed project.” He highlighted that the board has acted in good faith throughout the review process, yet the severe and wide-ranging negative impacts of the project on residents have been ignored.

Memorial Circle, the proposed site for the Triumphal Arch, is situated on federal parkland west of the Potomac River, adjacent to Arlington County. The county’s legal representation comes from Democracy Forward, a legal advocacy organization dedicated to promoting democratic values.

The lawsuit’s timing is notable, coinciding with concerns voiced by Sara Nelson, President of the Association of Flight Attendants-CWA. She expressed worries that the 250-foot arch could exacerbate existing safety issues, particularly following a tragic plane crash over the Potomac River in January 2025 that resulted in 67 fatalities. Nelson also criticized the proposal to transform the arch into a military complex with capabilities to host drones and snipers.

While the U.S. Commission of Fine Arts has granted early approval for the arch—comprised of members appointed by Trump—there are ongoing legal challenges. A separate lawsuit filed by veterans and an architectural historian in Washington, D.C., asserts that congressional approval is necessary for the project. A judge in that case has mandated that the administration provides 48 hours’ notice before any activities related to construction commence.

The Triumphal Arch is one of several controversial projects initiated by Trump as part of his vision to reshape the capital. This includes plans to renovate a historic public golf course and proposals that could lead to the demolition of the John F. Kennedy Center for the Performing Arts, stirring public debate about the future of Washington’s landmarks.
