‘She put me in handcuffs’: Attorney speaks after ex-Judge Speedlin Gonzalez was kicked off bench

SAN ANTONIO – In a significant legal controversy, San Antonio defense attorney Elizabeth Russell has come forward to discuss her 2025 criminal complaint against Judge Rosie Speedlin Gonzalez. This complaint ultimately led to the judge’s indictment and her acceptance of a lifetime ban from the bench, marking a pivotal moment in Texas judicial history.

Russell’s decision to involve law enforcement was not taken lightly. The incident unfolded during a courtroom dispute in December 2024, when Speedlin Gonzalez ordered Russell to be handcuffed and placed in a jury box—a move that Russell found both shocking and unjustified.

A Tense Courtroom Atmosphere

Russell described her feelings as she entered the courtroom, admitting that she felt she was “on pins and needles.” This anxiety stemmed from multiple prior incidents in Bexar County Court-at-Law 13, where Speedlin Gonzalez had threatened to hold her in contempt.

The hearing on December 17, 2024, quickly escalated when Russell’s client mistakenly pleaded true to an allegation. Russell attempted to clarify that her client had misspoken, but Speedlin Gonzalez accused her of coaching the client instead.

In a tense exchange, the judge warned Russell, “You either will hold your tongue and act professionally, or I’m going to hold you in contempt.” Shortly thereafter, Speedlin Gonzalez ordered a deputy to handcuff Russell and move her to the jury box, a decision that Russell described as unprecedented and unjust.

Russell emphasized that it was not merely the act of being handcuffed that upset her but the lack of due process accompanying the judge’s decision. Following the incident, the Texas Rangers initiated an investigation, which revealed further troubling details.

Notably, Speedlin Gonzalez’s court reporter, Olga Gutierrez, recorded audio of the hearing but later deleted it, claiming it was customary in her profession to do so. This deletion raised questions about the transparency and integrity of the proceedings.

In January, a grand jury indicted Speedlin Gonzalez on charges of unlawful restraint and misdemeanor official oppression, leading to her suspension without pay by the State Commission on Judicial Conduct (SCJC).

Claims of Discrimination

In a public address to supporters, Speedlin Gonzalez framed her legal troubles as a matter of discrimination, asserting that her case represented broader societal issues affecting women, Latinas, and bilingual individuals. “When they come for me, they come for everyone,” she claimed, suggesting a systemic attack on marginalized communities.

Russell countered these assertions, stating, “She put me in handcuffs. It was her actions that caused me to file the complaint.” Russell insisted that her motivations were solely to protect her client’s rights within the legal framework.

Following her primary loss to attorney Alicia Perez, Speedlin Gonzalez made a brief court appearance regarding the criminal case, after which she resigned from her position, agreeing to a deal that includes a ban from serving as a judge in Texas.

Despite the serious nature of the allegations against her, the special prosecutor ultimately decided to dismiss the criminal charges after discussions with Russell. “I just want there to be justice,” Russell remarked, emphasizing her desire to prevent similar abuses of power in the future.

In addition to the criminal charges, the SCJC has received multiple complaints regarding Speedlin Gonzalez’s conduct, including allegations of issuing a no-contact order via email, which barred her staff from communicating with former court employees. These complaints were set aside as part of her resignation agreement.

As the situation continues to unfold, it raises critical questions about judicial accountability and the treatment of legal professionals within the court system. Russell’s experience serves as a cautionary tale, highlighting the need for transparency and fairness in judicial proceedings.

Speedlin Gonzalez did not respond to requests for an interview regarding this matter.
